In Grisham’s Innocent Man, one of the wrongfully convicted was bitter and argumentative. Yet proved innocent by the evidence. You all make great points. Thanks for covering this case in depth.

... neiborhood man was accused of ”grooming” or ”luring” a teenage girl into his home and having his way with her. Possibly charges would have been dropped because, if she was lured repeatedly, the police may have looked at it as a ”willing” participation. Look for a case in Mason City were a teenage girl was assaulted by a neighbor (within two houses) in late 80’s, early 90’s. Then see if anything matches the known evidence.
I am surprised that an accomplice wasn’t even considered here. One driving, the other grabbing her. It would have been difficult for one person to grab her, subdue her, and drive off so quickly. These methodical preditor types will often enlist a younger relative that they have some sort of control over. Joe and Dylan need to be tried for murder. By trying the TWO, Victor becomes a victim and the other TWO bevone even more calloused and evil.

A confusing element like that should not be a centerpiece, taking up much time, of a case like this. Focus on the timeliness, the scream, Joe’s and Dylan’s irreverent attitude towards others. There is enough there to say these two attempted to drug and rape Robert and things went wrong. Try the TWO for murder ..
If Victor is not a defendant, and portrayed as a victim, the prosecution can go harder at the other two. ”The scream” could be presented as Victor’s when he finds out Robert is dead. Present it as that, and it allows the listener (the judge or jury) to draw the conclusion that it makes sense. The other part of story telling is how much time/energy you spend on one thing. Let the ”blood” go. It’s confusing and retracts from the other parts of the case. The prosecution doesn’t have to explain
The problem with this prosecution is the way they tell the story. On this podcast, the lead prosecutor paints Victor as a ”victim”. The case should have been tried like that. That human element of sympathy is working against you when Victor (a sympathetic figure) is a co-defendant. With the only option is guilt or innocence, its hard to be convinced all 3 were involved in the murder. However, if you paint Victor as a victim, that same emotion, sympathy, is in your corner.
Low heart rate or stopped heart would prevent blood from pumping out of body. The Podcast ”The Prosecutors” covered this point. Some drugs, like suxinolcholine, cause low heart rates. Blood that doesn’t get pumped out of body could pool inside the body.

The ”ransom” was a distraction (”small faction”, ”two men that have her”) to try to veer away from a sole perpetrator, veer away from his true identity.
