For decades DuPont’s Zinc Smeltering Plant produced layers of contaminated waste that created a 100-foot tall noxious dust mountain in the tiny town of Spelter, West VA, permeating the neighborhoods and infiltrating the West Fork River that surrounded the facility. The toxic air emissions and dust from the operation of one of the largest zinc smelter facilities in the United States became a medical nightmare for scores of local residents exposed to potentially harmful by-products of arsenic, cadmium and lead. In 2004 ten residents filed an environmental class action, known as Perrine v. DuPont, on behalf of themselves and others against the responsible companies for property damages, medical monitoring and punitive damages.
Carol Moore was the lead investigator for the law firm who successfully litigated the case on behalf of more than 7000 residents. Tune in to here Carol tell the story of her investigation of this complicated case that ended in a most remarkable outcome.
