This morning we discuss the Jewish calendar, first initiated just before Exodus on 1 Nissan (the first day of the Jewish month of Nissan), and the way it is implemented by judges, not clergy or scholars. We demonstrate how in the times of classical Jewish Law, both the calculation of a lunar leap year (like this year) and the proclamation of the new lunar month, were judicial proceedings. And we examine what this says about the scope of Jewish Law, and how a legal proceeding is used to promote social welfare.
Michael Whitman is the senior rabbi of ADATH Congregation in Hampstead, Quebec, and an adjunct professor at McGill University Faculty of Law.
