Exceptions to the Search Warrant Rule, Michigan Lawyer, TODD L. LEVITT, HUGE SHOW!!!
Knowing how to legally search a person, place or thing and properly seizing evidence are basic requisites to the investigative process. Police officers must have a clear understanding of when a search and/or arrest warrant is required and when it is not. The Fourth Amendment protects citizens from unreasonable government searches and seizures of their persons, houses, papers, and effects. However the U.S Supreme Court and federal courts have carved out specific, limited exceptions to the Fourth Amendment search warrant requirement, which are referred to as the seven exceptions to the search warrant rule. In this episode, Todd takes the listener through fact patterns covering three of the seven exceptions: Plain View Doctrine, Consent and Search Incident to a Lawful Arrest. Todd is joined in studio once again by Little John and Craig Russell.
